Italy: Information on whether an individual born of an Italian father and a non-Italian mother is entitled to Italian citizenship

 

For information on the above-mentioned topic, please consult article 1.1 (a) of an unofficial translation of Act No. 91 of 5 February 1992 on Italian citizenship, which came into force on 15 August 1992 (UNHCR/REFLEG). This translation is attached to Response to information Request ITA20073.E of 10 March 1995 which is available at your Regional Documentation Centre.

The attached extract of the Council of Europe's European Bulletin on Nationality states that "Italian citizenship is based on the criterion of 'jus sanguinis'. The child of an Italian father or mother is Italian" (Jan. 1995, 73).

This Response was prepared after researching publicly accessible information currently available to the DIRB within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
