Comments This judgment will become final in the circumstances set out in Article 44 § 2 of the Convention. It may be subject to editorial revision. The Court ruled that the indiscriminate use of weapon was not compatible with the standard of care prerequisite to an operation involving the use of lethal force by State agents in violation of Article 2 ECHR. The absence of a state of emergency declared in Chechnya and of a provision in the domestic legislation governing the use of force were also considered by the Court. In this case, Russia was also held responsible for the lack of an effective investigation.
