Spain: Citizenship eligibility for spouses of Spanish citizens; procedures and requirements (including residency requirements) for acquisition of Spanish citizenship by spouses of Spanish citizens

For information on the acquisition of Spanish nationality (not citizenship) by foreign nationals, including foreign spouses of Spanish nationals, please refer to ZZZ41170.E of 9 April 2003 and its attachments.

The Spanish Ministry of Justice states that foreign spouses of Spanish nationals are required to reside legally in Spain for at least one year in order to be allowed to request or apply for Spanish nationality (Kingdom of Spain 10 Oct. 2003). An application form, available through the Website of the Ministry of Justice or through its offices in Spain, must be filled and submitted to the Civil Registry (Registro Civil) in the area where the applicant resides (ibid.). Please find attached a translated copy of a document that explains the residency and documentary requirements foreigners must meet in order to obtain Spanish citizenship.

This Response was prepared after researching publicly accessible information currently available to the Research Directorate within time constraints. This Response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum.
