Yemen: How a person who was born outside Yemen but whose father is Yemeni can have his or her Yemeni nationality recognized by the Yemeni authorities

The following is excerpted from the Yemeni legislation entitled "Republican Decree No. 3 of 1994: Executive Regulation of Law No. 6 of 1990 AD Concerning the Yemeni Nationality":

Article 7

To establish the nationality of the children of Yemeni emigrants ... the following shall be a condition:

1) Establishment of the parenthood/branch of the father legally.

2) That there should not occur a discontinuation between the branch and the homeland for more than fifty Gregorian years.

...

Article 8

... the nationality of the children of the Yemeni shall be established by all means of proof, among them the following:

1) The birth certificate issued outside the homeland.

2) The father's personal identity card or the family card.

3) The passport of the mother.

4) The travel document or the passport by which he arrived at the Republic [of Yemen].

5) The identification form prepared by the [Yemeni Immigration, Passports and Nationality] Authority and issued by a resolution of the Minister.

The following is excerpted from the Yemeni legislation entitled "Republican Decree No. 2 of 1994 Concerning the Executive Regulation of Law No. 7 of 1990 Concerning Passports":

Article 3

Whosoever enjoys the Yemeni nationality shall be granted a passport in accordance with the following conditions and circumstances:

...

The applicant who is the son of a Yemeni emigrant domiciled in the country emigrated to, have to produce a birth certificate and fill the application form and which must be endorsed by the accredited diplomatic mission.

Article 6

An exigent travel document shall be issued for one trip only and shall be granted under the following circumstances:

...

Those who are born abroad to Yemeni emigrants and do not hold Yemeni documents establishing their identities after co-ordination with the Yemeni diplomatic or consular missions.
