Presidential Decree No. 38 of 1979 Relating to Vietnamese Asylum-Seekers

Date of entry into force:11 September 1979

Article 1

The settlement of the Vietnamese refugees in Indonesia will be carried out in an organised and coordinated way based on policies stipulated by the Government.

Article 2

(1)The Defence Minister coordinates the implementation of the settlement of the Vietnamese refugees in Indonesia.

(2)The Department of Defence and Security has the task and is responsible for the implementation of the administration, the handling, the processing and the security of the Vietnamese refugees in Indonesia.

Article 3

The Minister of Foreign Affairs has the task to arrange contact with UNHCR, and with the third countries that are willing to accept the refugees, in the framework of expediting and facilitating the settlement of the Vietnamese refugees in Indonesia.

Article 4

The Minister of Home Affairs and/or the concerned Regional officers have the task of dealing with the Vietnamese refugee problem in the regions, including instruction of facilities for the camps for the refugees without causing heavy burden to the local population.

Article 5

(1)Form of the co-ordination for the Vietnamese refugees caseload is further arranged by the Minister of Defence and Security after hearing the judgment of the Foreign Affairs Minister, the Minister of Home Affairs and other Ministers/Offices in their respective fields.

(2)For the smooth settlement of the co-ordination in tackling the Vietnamese refugee problem, the Minister of Defence and Security may set up a coordination team at the Central government level as well as in the region, comprised of members of those departments/offices as considered necessary.

(3)The determination of the duties, competence and responsibility of the team mentioned in para (2) of this article is further arranged by the Minister of Defence and Security.

Article 6

The decree of the President is effective as from 11 September 1979.
