UNHCR reiterates concerns over continued restrictions on access to asylum, welcomes review of Hungary's asylum framework

UNHCR, the UN Refugee Agency, reiterates its concerns regarding continued restrictions on access to asylum in Hungary while welcoming the Government's commitment to review the country's asylum framework and related legislation.

The Agency notes the recent decision of the Government of Hungary to extend, until the end of 2026, the decree authorizing the police to automatically and summarily remove people intercepted for irregular entry or stay, including those who apply for international protection.

UNHCR recognizes States' legitimate interest in ensuring effective border management and addressing irregular movements. However, the Agency remains seriously concerned that the current framework continues to prevent many people who may be in need of international protection from accessing asylum procedures in Hungary. UNHCR has consistently raised concerns about these measures since the introduction of the decree on the "crisis situation caused by mass immigration" a decade ago, in 2016.

Of particular concern is the continued use of measures allowing the summary removal of people intercepted for irregular entry or stay, as well as the requirement for asylum-seekers to initiate the asylum process through Hungarian Embassies in Serbia or Ukraine. UNHCR considers that these measures significantly limit access to asylum and the right to seek asylum. They are also inconsistent with the principle of non-refoulement, which prohibits returning anyone to a place where they would face danger due to conflict, persecution, or serious violations of human rights.

At the same time, UNHCR appreciates Hungary's continued solidarity with refugees fleeing the war in Ukraine and encourages the application of the same principles of protection and access to asylum to all persons seeking safety, irrespective of their country of origin.

UNHCR welcomes the Government's commitment to review the relevant legislation in the coming weeks. The Agency urges the Government of Hungary to establish a sustainable framework, through a transparent and consultative process, that balances effective border management with access to asylum and is fully aligned with Hungary's obligations under international and European law.
