無国籍の情景:国際法の視座、日本の課題
国連難民高等弁務官事務所（UNHCR）の推計によれば、現在およそ1200万人の無国籍者が世界にいます。無国籍者の苦境は日本においてもその他の地域においても未だ殆ど知られていません。
国籍がないがゆえに、無国籍者は身分証明書を入手することや、滞在国における法的地位を確立すること、そして他国への渡航のためのパスポートやビザを入手することが困難です。多くの場合、彼らは国家や社会が国民や居住者に与える法的保護及び社会保護を享受できません。このように、雇用、社会福祉、教育及び健康管理へのアクセスを含め、彼らは日常生活において、多くの法的・事務的な障害に直面しています。
UNHCRは、国連総会によって、無国籍者のための活動をし、彼らの無国籍状態を防ぎ、苦境の解決に取り組むという任務を負っています。現在、日本における無国籍者の問題についての参考になる情報は限られております。また、無国籍の状態にいる者と「無国籍のような」状態にいる者についての議論がほとんどなされていません。そのため、UNHCRは神奈川大学法科大学院の阿部浩己教授に自主研究を委託しました。研究は、無国籍問題に関する既存の国際法上の枠組みそして日本における同問題を分析・考察します。阿部教授は「無国籍の情景―国際法の視座、日本の課題」本研究書にその分析・考察を盛り込み、研究の結果及び提言を示しています。本研究書の重要点として、日本は無国籍者に関する条約に加入すべきだというものがあります。これに関連して、適切な無国籍者認定の手続きの設置も提案されています。
UNHCRは、本研究を発表し、本研究結果及び提言を共有するため、また、政策立案者を含めより多くの一般の皆様に日本における無国籍に関する議論を始めるためのきっかけを提供するために、本セミナーを開催いたします。中央大学法科大学院の横田洋三教授が、国際的視点及び国連の視点から無国籍について基調演説を行います。阿部教授が、研究結果を踏まえ、提言します。引き続きパネル・ディスカッションでは、実務家、研究者、無国籍者本人が様々な視点から当問題を、議論することによって今後の方向性を示唆することを期待します。

Overview of Statelessness: International and Japanese Context
UNHCR estimates that approximately 12 million people are stateless in the world today. Still, the plight of the stateless has attracted little attention whether in Japan or elsewhere. Having no nationality, stateless people have difficulty in obtaining identification documents, securing a legal status in their country of residence, obtaining passports for travel to other countries. Mainly, they may not enjoy the legal and social protection that a state or society offers its citizens and residents. As such, they face a number of legal and administrative hurdles in their daily lives, including access to employment, social services, health care and education.
UNHCR has a mandate, given by the UN General Assembly, to act on behalf of stateless people and to prevent and to seek to address their plight. At present, only scarce information is available on the issue of statelessness in Japan. Further, hardly any discourse is taking place on those who are in stateless or ‘stateless like’ situations. Therefore, UNHCR Japan commissioned an independent study on statelessness in Japan to Professor Kohki Abe of Kanagawa University Law School. The study examined the existing international legal framework of statelessness and related issues in Japan. Professor Abe incorporated this examination and highlighted key findings and recommendations in the report, “Overview of Statelessness: International and Japanese Contexts.” One key recommendation is that Japan accedes to the Conventions relating to Statelessness. A related recommendation is the establishment of proper procedures for statelessness status determination.
UNHCR is organizing this seminar to launch the report and to share the findings and recommendations of the study, and provide an impetus for relevant stakeholders including policy makers and the wider public to begin the discussion on statelessness in Japan. The keynote speaker, Professor Yozo Yokota, Professor of Chuo University Law School will address the audience on statelessness from a global and UN perspective. Professor Abe will present the findings and recommendations. In the ensuing panel discussion, practitioners, academics and a stateless individual will shed light on the issues from a variety of perspectives and perhaps suggest a way forward.
